1. Overview
The Thikano app and website are operated under the brand name Thikano. Throughout these terms, "we", "us", and "our" refer to Thikano. By accessing the app, using the website, joining the waitlist, using our services, listing a property, booking or purchasing an eligible listing-related service, or making a payment, you agree to these Terms & Conditions, our Privacy Policy, Cancellation & Refund Policy, and other policies linked on the website or app.
2. Service Description
Thikano is a digital property listing, rental transaction, and payment platform for owners, PG operators, small property managers, and tenants. The service may include property listing tools, tenant profiles, listing discovery, booking or purchase-related workflows, rent calculation, payment records, receipt tracking, owner-tenant communication, support features, product information, early-access registration, legal policies, and online payment flows.
3. Eligibility and User Responsibilities
- You must provide accurate, complete, and current information when using Thikano.
- You are responsible for maintaining the confidentiality of your account credentials and activity.
- You must not use Thikano for unlawful, fraudulent, misleading, harmful, or unauthorized purposes.
- Owners are responsible for the accuracy of property listings, pricing, availability, rent, tenant, booking, purchase, and payment information they enter.
- Tenants are responsible for reviewing property details, listing terms, rent or purchase-related amounts, payment amounts, and receipts before taking action.
4. Payments
Payments are planned to be processed through Razorpay. By making a payment, you agree to provide accurate billing and payment information and authorize the payment for the displayed amount. Payment success, failure, settlement, refunds, and disputes may be subject to Razorpay, bank, card network, UPI, and applicable payment system rules.
Thikano may maintain payment records such as transaction ID, order ID, amount, payment status, payment date, and receipt details. We do not store sensitive payment authentication data such as full card numbers, CVV, UPI PINs, or net-banking passwords.
5. Property and Rental Transactions
Thikano enables owners to list properties or rooms and enables tenants to discover, book, purchase access to, or pay for eligible listing-related services digitally through the app or website. Thikano does not physically deliver property, transfer possession by itself, inspect every listing, guarantee title or ownership, or become a party to offline possession, registration, deposit, damage, move-in, move-out, or settlement arrangements unless expressly stated in writing. Users should independently verify property details, identity, pricing, ownership, permissions, and legal obligations before entering into any property, rental, booking, or purchase arrangement.
6. Prices, Plans, and Service Changes
Prices, subscription plans, service fees, convenience fees, or feature availability may change from time to time. We may modify, suspend, or discontinue any feature or service where needed for operations, security, compliance, maintenance, or business reasons. If a paid service is materially affected, refund eligibility will be handled under our Cancellation & Refund Policy.
7. Accuracy of Information
We make reasonable efforts to keep app, website, and service information accurate, but we do not guarantee that all content is always complete, current, or error-free. We may correct errors, inaccuracies, or omissions and update information without prior notice.
8. Third-Party Services
Thikano may use third-party services including Razorpay, Firebase, hosting providers, analytics, notification services, app stores, and communication tools. Your use of third-party services may be subject to their own terms and policies. We are not responsible for third-party websites, payment pages, app stores, or services outside our control.
9. User Content and Communication
You are responsible for content you submit, including property details, listing prices, availability, tenant information, booking or purchase details, messages, documents, images, and feedback. You must not upload or transmit content that is unlawful, false, abusive, defamatory, infringing, obscene, discriminatory, malicious, or harmful to the service or other users. We may remove content or restrict access where we reasonably believe policy violations, legal risk, fraud, or security issues exist.
10. Prohibited Uses
You may not use the app, website, or services to violate laws, infringe intellectual property, harass others, submit false information, upload malware, spam, scrape, phish, collect personal information without authorization, bypass security, manipulate payments, or engage in fraudulent property listing, booking, purchase, rental, or payment activity. We may suspend or terminate access for prohibited use.
11. Intellectual Property
The Thikano name, branding, app and website design, text, graphics, software, and platform features are owned by or licensed to Thikano. You may not copy, reproduce, sell, resell, exploit, or misuse any part of the service without written permission, except as allowed by law.
12. Privacy
Your submission of personal information through the app, website, or services is governed by our Privacy Policy.
13. Disclaimer of Warranties
The app, website, and services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, secure, timely, error-free, or fully accurate service. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and reliability.
14. Limitation of Liability
To the maximum extent permitted by law, Thikano shall not be liable for indirect, incidental, special, punitive, or consequential damages, loss of profits, loss of data, loss of revenue, listing disputes, property disputes, booking or purchase disagreements, rental disagreements, third-party payment delays, or user-entered inaccuracies arising from use of the app, website, or services. Our total liability, if any, will be limited to the amount paid by you to Thikano for the specific paid service giving rise to the claim.
15. Indemnification
You agree to indemnify and hold harmless Thikano, its owners, officers, employees, partners, service providers, and affiliates from claims, losses, damages, liabilities, and expenses arising from your breach of these terms, misuse of the service, violation of law, payment disputes caused by your actions, or infringement of third-party rights.
16. Termination
These terms remain effective until terminated by you or us. We may suspend or terminate access if you violate these terms, create legal or security risk, provide false information, misuse payments, or engage in prohibited conduct. Obligations related to payments, refunds, privacy, liability, indemnity, and dispute resolution survive termination.
17. Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of India. Courts and competent authorities in New Delhi, Delhi shall have jurisdiction, subject to applicable law.
18. Changes to Terms
We may update these terms by posting revised terms on this page. Continued use of the app, website, or services after updates are posted means you accept the revised terms.
